Terms of use

This Terms and Conditions Agreement ("Terms and Conditions") between you and FIGMATION (“FIGMATION”, “Management”, “we”, “us”, “our”) and applies to your use of FIGMATION’s Services (the “Services”). You must read, agree with and accept all of the terms and conditions contained in this Agreement. Before you make any purchases, you must first establish a customer account.

1. Introduction

FIGMATION is an online specialty store based in Singapore. Incorporated in 2012, we aim to fulfill every enthusiast’s entertainment needs by providing a large variety of distinctive merchandise.

FIGMATION strives to be the best online retailer to cater to the needs of customer. Our on-line store offers exciting features and functionality to reflect product information, convenience and customer service. In additional, we hope that it will create a unique on-line shopping experience for customers.

Our various interest groups provide a place for all customers who share common interest to gather and discuss about what they like and our FIGMATOR’s Corner is specially set for our customers who want to put up their own merchandise for sale.

2. Eligibility for Service

a. The Services are only available to customers who have signed up, establish and maintain a FIGMATOR’s Account with FIGMATION.

b. You must at all times provide us with such information as may be necessary or desirable for us to provide you with the Services.

c. We may decline acceptance of your application at our discretion.

d. You may not transfer or assign any rights or obligations you have under this Agreement without FIGMATION’s prior consent.

e. We reserve the right to transfer or assign this Agreement or any right or obligation under this Agreement at any time.

3. Retail Price and Cost of Product

a. The retail price of the product stated herein shall be subjected to review by FIGMATION from time to time at its discretion.

b. You must ensure that some particular products are to be sold to end customer at the retail price set by FIGMATION for some territories.

c. In the event that you desire to amend the retail price and/or cost of our products beyond the scope of this authorization, it shall be subject to a separate written consent officially signed by the Parties.

d. We reserve the right to immediately suspend or terminate the Services if we determine, in our absolute discretion, that you adjust the retail price without authorized consent.     

4. Order Deadline

We recommend ordering / pre-ordering as soon as possible when you receive product solicitation so we can ensure your orders. To ensure that you get the product and quantity you order, make sure you order before the deadline. Orders placed after deadline is not guaranteed and may not be fulfilled.

5. Estimated Release Date

a. Estimated Release Date is only an estimate date of when FIGMATION will get the products. It may not reflect the actual manufacturer release date. Release date could be subjected to change without further notice.

6. Order Fulfillment

a. Orders will be fulfilled immediately upon the arrival of the products.

b. Notifications will be sent to you via emails upon the arrival of any products.

c. All orders will be processed within 3 working days upon the arrival of products.

d. An invoice of the remaining balance of the product price and shipping fee, if any, will be sent to you when shipment is ready. Once payment received, we will ship to you immediately.

e. We are unable to hold orders more than 30 days.

7. Stock Shortage

a. All Pre-Orders and Back-Orders will be processed immediately upon arrival of products. Stock shortage is very rare but if stock shortage ever occurs, orders are allocated to those who have made full-payment first. Subsequently, “Pay upon Arrival Customers’ will receive their goods chronologically, on a first come-first served basis. Time stamps upon receipts or purchase orders, will be recorded in case of any disputes that may or may not arise. 
b. Sometimes, manufacturers release products in batches over a period of a few months apart which causes significant stock shortage and delays. Orders which are not fulfilled in the first batch of release will be fulfilled immediately upon the arrival of new batches.

c. Immediate refund of deposit will be made to you if we are unable to fulfill your order.

8. Cancellation

a. FIGMATION will not accept cancellation for any reasons.

b. Cancellation of Order will result immediate termination of account and use of FIGMATION's Service.

c. All pending orders will be void upon termination of account.

d. All payments or deposits made prior to termination of account will be forfeited.

e. FIGMATION reserves the rights to take legal action against you to claim back all existing orders payments, all sums due, accruing due or payable to us in respect of the Services upon termination.

f. You will be responsible for all reasonable expenses and legal fees incurred by FIGMATION in collecting back all existing orders’ payments, all sums due, accruing due or payable to FIGMATION.

9. Shipping Services

a. You are responsible for all shipping cost, duties, tax, and insurance.

b. Available shipping company are as follows:

i. Singapore Post, http://www.singpost.com/

Available shipping services provided by Singapore Post are as follows:

i.   Speedpost EMS: varies from 1 to 7 working days

ii.  Air Parcel: varies from 7 to 20 working days

iii. Air Small Registered Parcel, only for shipment not exceeding 2kg: varies from 7 to 60 working days

c. You are able use your own shipping company to pick up your shipment from us.

10. Lost or Damage

a. If damages are caused during shipping, please contact shipping courier. FIGMATION is not responsible for lost or damages caused by shipping courier during shipping process. We strongly encourage you to buy insurance for your shipment.

b. We regrets to inform you that we do not accept requests for compensation or replacement of product due to superficial shipping damage to outer packaging, such as bends, creases and minors.

11. Sales of Returns (SOR)

a. (SOR) are only applicable to products that are found to be faulty and have to be rejected at the point of receiving. All other reasons will be subjected to approval from the management of FIGMATION.

b. You have 7 days to inform us about the defects and obtain approval for return of product. Please note that unapproved return of product will be disregarded.

c. All Approved SOR has to be packed and sent back in a proper and secure way.

d. You are responsible for the shipping fee to send to us.

e. SOR will be examined and if defects are genuine, exchange of product will be sent out in 7 working days.

f. We will be responsible for all shipping fees, which include the shipping fee to send product back to you and the shipping fee that was paid by you when shipping to us, if defects are genuine.

g. All reports of defective products after 7 days upon receiving will be disregarded.

12. Ordering Cut-off time

a. Cut-off time for orders for the day is scheduled at 5pm [(UTC +08:00) Singapore] daily.

i.   Order must be placed via our On-line store, http://figmation.net/store

ii.  Order must be placed before 5pm[(UTC +08:00) Singapore], in order to be processed on the day itself;

13. Payment

a. Payment of Orders will only be required when Orders are ready to be shipped to you.

b. Available modes of payment are as follows:

i.    Bank Transfer, bank fees apply;

ii.  Credit Cards via Paypal, Paypal fees apply;

iii. Credit Cards via Skrills, Skrills fees apply;

iv. Western Union, Western Union fees apply.

14. Account Information

a. Please update all necessary information by logging into your account whenever there are any changes.

b. To ensure a safe and secure environment for our customers to shop with us, at times, we will request you to provide us a copy of your driver's license or other government issued ID, with your name and address clearly visible for account verification.

15. Past Due Invoices

a. Order will be considered as cancelled if payment not received after 7 days upon receiving our notifications. Information on our cancellation policy can be found in Point 8.

16. Ending the Service

a. Without prejudice to the rights either party may have against the other party under this Agreement for any antecedent breach of this Agreement. The Services under this Agreement or this Agreement may be terminated by either party giving 1 working day notice to the other party without assigning any reason.

b. If you give us notice of termination with outstanding orders / payment:-

i. you must immediately pay us for the outstanding amount;

ii. outstanding order(s) will be voided with immediate effect.

c. In the event of any of the following:-

i. you breach any of the terms and conditions of this Agreement or any other agreement you have with us;

ii. you become or threaten to become bankrupt or insolvent, or die;

iii. you make any arrangement or composition with or assignment for the benefit of your creditors or go into either voluntary or compulsory liquidation or a receiver, trustee, judicial manager or administrator is appointment over any of your assets;

iv. the equivalent of any of the events referred to in paragraphs (ii) and (iii) above under the laws of any relevant jurisdiction occurs to you;

v. you provide incorrect, false or incomplete information to us;

vi. the requirements of any relevant regulatory authority result in us having to stop the Service or to provide the Services in a manner which is unacceptable to us;

vii. if you are likely to create imminent harm to our provision of the Services, or defraud us, or are likely to create imminent harm or are abusive to our personnel.

d. In the event that we suspect you are using or allowing the Services to be used for fraud, misconduct or any other illegal or improper purpose, we will refer this to the relevant authorities without notice to you and comply with directions or guidelines issued by then without further reference to you.

e. If the Services are terminated:-

i. all sums due, accruing due or payable to us in respect of the Services, up to the date of terminations (including late payment charges) will, upon termination, become immediately due and payable to us;

ii. we reserves the rights to take legal action against you to claim back all existing orders payments, all sums due, accruing due or payable to us in respect of the Services upon termination.

iii. You will be responsible for all reasonable expenses and legal fees incurred by FIGMATION in collecting back all existing orders’ payments, all sums due, accruing due or payable to FIGMATION.

17. Changing the Agreement

a. We may from time to time change any of these Terms & Conditions and/or such other terms and conditions agreed or accepted by you. We may also from time to time, withdraw, suspend, or change the Services or any part thereof. Such changes will take effect as from such date as we may determine. We will notify you of such changes through written notice, electronic mail, our website or such other form as we may deem appropriate. You agree that the display of the revised Terms & Conditions on our website will constitute notice of the changes. Your continued use of the Services will constitute acceptance of the changes.
